The 3% actually is counting for human error. Like leaving them somewhere really hot (like a glovebox), or a tear, or expiration. If they're used properly, and maintained properly, it's 100% effective.

Well unfortunately we are human so they will never be 100% effective.

In one of the walk throughs they said that regular woohoo could result in pregnancy, the odds are suppose to be high.

This happened to me in the Sims 3 actually. They already had 4 kids and didn't need any more. It But, they love to woohoo. hasn't happened so far in the Sims 4.
