Why is this happening in build mode?
My sims aren't able to go through the gate because of that foundation, and it won't let me put stairs there. (Plus, even if it did allow me to put stairs there, I'd rather not waste money on one step....

To have a fence without the foundation on it, you'll need to draw the fence starting at a point AWAY from the house and draw towards then attach to the house. If you start the fence from the house going out it'll attach the foundations to it and then you can't use gates.
