Nothing in the TOS forbids smurfing. The fact that the minimum required level for ranked is 10 is a proof that Respawn WANTS people to smurf. They only care about numbers, not fair play so they would have a "semi-high" elo player, who is hardstuck on his main, to log on to a smurf and keep on grinding ranked, rather than having him getting tired of the game and uninstall. Also, how could they even prove that someone is a smurf and not just someone who just dont play ranked that much but still is has the skills of a 4k, 20 kills from pubs? OR perhaps a pro FPS player who just started to play this game and immediately reached high elo skills on his actual main low level account?
Add all these things together and its almost guaranteed that the smurfing report button is meaningless. Its rather to protect smurfs from being falsely banned for hacking, since without the smurfing report button, people would report them for hacking instead.

The only thing Respawn or a developer at Respawn has commented on this is they will only ban accounts that "create new accounts consistently to farm lower level lobbies" but they also explicitly confirmed that they will NOT bann "normal" usage of smurfs, i.e if a high elo pred player has a couple of accounts that he uses to solo grind from Bronze every split and I think this type of smurfing is the absolute most common type of smurfing.
So in practice, smurfing IS legal unless you create new accounts over and over to get access to the "new account" lobby until you get the 4k, 20kill banner you are hunting.
