Does it use the hardware or is it a software driver? Hardware rapid fire is done with a 555 timer chip. It requires no software and is impossible to detect. If you ask tech support, they may not know for sure either.
a ruling by the authorities would really be needed.
My personal advice; If it "feels" like a cheat just don't use it.
