I neglected to mention it's a hardwired connection. Sorry got caught in a rant. On suggestion of my ISP tech (lower tier lol) I tried circumventing the router and plugged the line in straight to the xbox. Doing that the Xbox gets every drop of bandwidth I have download 500+mbps and upload 400+mbps and it still lags, still red connection symbols, still non registering shots. All of this occurs periodically but it also seems like as long as I'm looting out of danger it runs a dream. It's just the combat that's an issue lol but hey I get to die wearing purple stuff. My understanding was the requirement here is 3.5 mbps, what gives ?
