That's like saying the bottom active guy in a launch arena shard could beat out the top guy in a new shard.
Duh. If you have too many guys in a shard, then absolutely split it into new shards. But they should be in their own new shards, not mixed in with existing shards - especially shards newer than the ones they were in.
