He obviously was part of the Empire at that point, even if it had not been announced yet. The empire really started when he became lord Vader. Plus, I think it was announced right after Mace got tossed out the window. Before the final fight scene between Vader and JMK.
The Empire starts in RotS, following Order 66, when Palps has his speech in the senate chamber and declares that the Republic has become the Empire. Ep. 1 of the BB happens at around that same time period. So, yes, Vader was part of the Empire before he fought Kenobi on Mustafar.
