I'm level 77. Why do I have to battle players that are above level 80? They are all gear tier 10 I can only be gear tier 9 right now. It seems like I should be battling players that are more equal to ...

Are you talking about PVP? All the players in your arena shard began around the same time, and will remain that way. Things will even out more the closer you get to max level.
