Literally selling characters, skills, and whatnot, would be completely legal. They can even put them out for F2P people on nodes to farm after a time without impacting legality. In fact it may help improve legality in the couple of places looking to outlaw, or severely restrict, RNG based systems as gambling. They don't like the whole "gambling" aspect of (in this game) Chromium packs, as an example. Those packs cost money, but are slot machine like, and have started to be considered gambling by some legal jurisdictions.
Let's look at it this way: They'll sell less crystals, but more characters/gear/skills/et al. The crystals would still be used for extra Arena stuff and whatnot, but that's fixed not something that could be considered "gambling" and therein can't be regulated. I've tried to price it out, roughly, at what they're trying to get for a character with gear now, so they won't really be down anything. As a matter of fact the certainty factor would probably get people to pony up more money.
