It takes a few seconds to start the battle up, then you are still able to use the full five minutes. I believe that he is locking you out for about 5min 15 seconds tops. My advice is to take first and battle someone just before he battles you, ans use the full 5 minutes. Odds are, he can't best you in that amount of time either.
