Custom Content Reuploads

Hello, I hope you can help me clear something up in regard to uploading custom content that has been previously shared by another user. I would like to get some clarification of the current EA user agreement, the term "EA Service", and its application to sharing user content in The Sims.



SECTION 5: ...You also grant all other users who can access and use your UGC on an EA Service the right to use, copy, modify, display, perform, create derivative works from, and otherwise communicate and distribute your UGC on or through the relevant EA Service without further notice, attribution or compensation to you.



This waives any obligation of notice/compensation resulting from user content distribution, *on* or *through* the relevant *EA Service*. So In the case of TS4, does *on or though the relevant EA service* reference distribution on a destination/platform? Is it the Community Page in-game, and EA websites? Or does it reference TS4 as a whole, and that everywhere sims user content exists, this place is now considered an EA Service?

If you accept this statement (distribute your UGC on or though an EA service) as referencing a destination/platform, then permissions to modify, edit, upload, or reupload by the community have been granted to a specific space. So at a place like The Sims Resource, Patreon, and various forums, one defers to the content distribution rules *at the upload destination* in conjunction with everything else in the agreement and what has been stated EA afterwards. This is my conclusion, and I am looking for confirmation as to whether it is true or not. People are using this statement to justify reuploads of UGC that are already being supported by the original UGC uploader, and I want to know if it applies strictly to a destination that EA controls.

Let me know what you think, if you believe my interpretation is flawed I'll be glad to hear it. Thank you for your time.

  • I think that it's mostly true, except that EA does not make that site a subservice, just grants the site permission to use its licenced content. Hope this helps!

    Its means that ALL players have the right to download, modify and upload ANYTHING that is shared in the Gallery.
    It does not mean that EA will protect any player whom initially uploads web images (in the form of art) or poses used on Sims.
    No player can claim EXCLUSIVE rights to anything they upload. That is the purpose of sharing to the Gallery. If a player uploads something, claims it and trys to tell another player what to do with it, it will be a big 'ol mess of fighting. That's not EA's intention.
    TOS does say if you bring 3rd party content (web images or poses) you have to list the 3rd party. And once its uploaded, it becomes User Generated Content (USG) to be used by any player in any way in order to play the game.

    This 'claiming ownership" or 'exclusive rights' is what is ruining the game.

    That's my opinion, from reading the TOS myself and with talking to EA Moderators at EA Help.com.

    I think the TOS is not 'open to inturpretation' and players should accept that and stop searching for someone to support their selfish views. Because there are currently groups that attack, insult, harass and ruin a players reputation because of what is being posted.
    There is no reuploading. There is no stealing. There is sharing. Got it? THAT is what the Gallery is about. Sharing.

    And my comments are my opinion which are not meant for anything else but an opinion.
