It is still a silly idea though when most creators aren't being paid for what they do.
I don't think they are allowed to be paid for their creations. Donations or patreons but I don't think they're actively allowed to charge for their mods or CC. I might be wrong but I can't recall seeing a creator charging for anything (other than merch) which makes me think they aren't allowed.
The legality of it is probably somewhere in the region of fanart and fanfiction. Technically falls under "transformative" but if there never was a lawsuit to determine the details then who knows. I'm guessing no one wants to be the first to challenge EA over rights.
Donations and Patreon tend to be easier overlooked because it's money for the modder/CCcreator's time rather than directly for the mods or items. (and EA knows not to step on that because of how much the community adds to the game). Directly selling CC pieces or charging for mods would likely not go down quite so well.
