You can not seriously be comparing a painting to something on the gallery? Not at all the same thing. For one the painting is using no ones content - it is a work of art by the artist and is completely owned by the artist with all rights only to the artist.
But gallery creation are made from content owned by EA who has all exclusive rights to every single part that makes up this game and we as the players of said game only have the right to use the game in the ways it allows - some of the play involves creating the characters and lots - but in no way do we own those things or have any rights to those things seeing all parts that make up our creations are owned solely by EA.
That is a totally different matter than a piece of art - which would be art thief to be sure. Not even comparable.
Just because the painter doesn't make his tools (paint, brushes etc.) himself you wouldn't say that his paintings aren't his creations and belong to the brush /paint maker instead. It's the same with creations shared in the gallery: EA provides us with the tools but the creators should be respected for what they made with these tools.
But please note that I'm NOT referring to the law! Sims players come from all over the world and that's why it doesn't make sense to discuss this topic with regards to any (assumed) legal rights or laws. Besides, I'm pretty sure that no one is seriously planning to engage an attorney for "stolen" creations on the gallery.
No, I'm simply referring to respect, politeness and a "common social sense". You shouldn't need a law for that. There are players who make such stunning creations and even find ways to deal with technical restrictions so that it feels like they don't exist for them. That's the "art" in it. But even without this kind of "art" there are at least the effort and time that every original creator invested in their work. And this should be respected. With "respected" I mean: Users shouldn't re-upload anyhing to create the impression that it's their own work. If you re-upload something because you want a backup then I find it completely okay if you mention it in the description.

Moreover, people upload their own creations for many reasons. Many of them do it because they want online backups - just like you. Because it would hurt a lot to lose something you have worked on for days or weeks. Not everyone wants "fame" - but even if some of them just wanted "fame" and attention: So what? The creator's reason for uploading their stuff is irrelevant when it comes to respecting their work.
Someone asked about the law - was responded to in regard to the actual law.
WE donot sign the Sims creations - the gallery sign it for us. As most of us well know up until recently when ever people re-uploaded changes to another simmers work - often the gallery assigned that work to the one that made the changes. To blame people for what the gallery did is wrong.
I know myself I downloaded a Sim from the Gallery after we got toddlers last year, that eventually married my sim and they had children. I built them a house that grew as the family grew and several times I shared the house. Someone saw my picture of house and family and asked me to share the family as they had the house so I did. The gallery gave me ownership of the family - even though I did not make the dad - I did make the mom's parents in an earlier game that had her. So I definitely made her. I even posted I did not make the dad - but I do not hold onto Sims I use, so had no idea who did and even that resulted in a creator who had said I stole their male - even though I mentioned in the post it was not my sim. THAT is BS in my view. I am not responsible in recalling every person who make what sim nor was I responsible for the Gallery calling the family a creation made by me - when technically I made none of them - their children and the mom were born in came - I made the moms parents. But shall I write a book with every sim family I share because one was not mine? That is ridiculous and the reason I stopped wanting to download anyones stuff but - maxis Creator 01. On top of it I was eager to try toddlers and did not have an available male. My female I actually aged up from teen even as she was the only unattached Sim I had at the time. This is just plain silly.
Like i said - they should just change the gallery to showcase only - no accolades - no downloads then if you feel that way. I also do not like nice people like Jimmysnan feeling upset by this constant finger pointing and she goes out of her way to make it clear she did not make that content.
It is not like Sims 4 is all that hard to work with - especially compared to Sims 3 that seriously took weeks and months of simmers hard work.
