This happens to me with lots all the time, I have to take my entire mods folder out just to be able to upload a CC-free lot without the "Modded" tag. :-/

I guess they could implement a change where you will not be able to share anything unless you're fully patched.
It seems this inadequate system penalizes normal legitimate creators, and is easy to cheat for those who aren't.
