Yes the kinect has to recognize you when you play else it wont work and you have to stand in the camera area.
Last I heard you could make 10 guest accounts to let them play.
Edit: There is no used game market because of this (You can only give them to people who have been on your friends list for at least 30 days and can only be given once) so if you give it to a friend he can't give it away ever.
And they said at launch: Loaning and renting games won't be available at launch. :?
