frame rate cap out of no where apex legends

I have a 75hz monitor so i set my frame rate limit 77 and it always works fine. Ps. i do al of this in nvidia control panel. But today when I tried to play apex the frame cap was 39 which is such a strange number that idk where it came from. But when i start the game in the loading screen it was 77 until it loaded in then it was 39. i went to control panel and checked global settings and the specific settings for apex. And I know that it is not my pc because i checked task manager and both cpu and gpu where under 30%.
