There's no penalty if you use it carefully. Finally. the slapdash stick lifts - as it was in previous NHLs - are gone! I hope they are gone forever.
Now you need to be in good position to make a correct stick lift or have a high discipline. The more stick checking and discipline attributes are high the less chance for a penalty. I know that many people decrease their discipline to increase deking and faceoffs and this is one of the steps to make penalties.
No more slapdash stick lifts and slapdash poke checks / defensive skill stick.
@EA_Aljo I hope you won't report it to Dev team, because it's not an issue. It's just a careless play in defence.

I actually do think it's a little too easy to take a penalty with stick lifts. However, as with the game each year, it takes time to adapt to gameplay changes. So, I hope we keep it as it is and see if we all can adapt. We'll have to wait and see if anything changes.

Yes, it work in certain situations, but it’s mostly broken. Any body to body contact while stick lifting will trigger penalty, not just stick to hands/face. It will even trigger (if below 80 discipline) if players have backs against each other and one is swinging stick in air. Broken.

Maybe you guys are spamming or something. My opponents make many penalties using the stick lift, but they do their stick lifts in NHL 22 way which is bad in NHL 23, and I like it.
I counted number of my stick lifts in NHL 23 tonight and here are the results:
* number of stick lifts - 37
* successful stick lifts without penalty - 34
* stick lifts caused penalty - 3
Only 3 penalties. Just play carefully and that's all.
In NHL 22 you could do the stick lift from anywhere and anyhow, mostly without any consequences which was an absurd for me. Are you sure you want to back to that?
