Legal action pursuable?

I am no lawyer or have no experience in law, but if pvz gw2 keeps the same state that it is currently in, is legal action pursuable? I mean I have seen many people in these forums saying that they paid money for the game, just to find out that it is completely broken and nothing like what they wanted. EA is charging money for a game that they know for a fact is broken, and has been broken for a long time now. They are even asking for in-game purchases. 

I don't know if legal action is possible, but at what point is this considered fraud?
