Need Bistan Feedback...possible bug?

Thanks. Assumed bc wasn't a chance ability was a guaranteed. Bc Even with a solid potency on him w quasi decent mods lol and 9% Republic buff per toon started seeing it to point where actually noticed opposed to pit where was virtually 100%. I assumed if attack was deflected or resisted would result in non tm down but even on successful crits was seeing it. Appreciate your input.
