Ok once again figured it out with a little help from
"TheChocolateGoat" on Apex and here was the simple solution:
If you have an ASMEDIA USB ports on your Motherboard (i have an ASUS MOBO)
and your headset is plugged into the back ports on the Mobo
change it to the top ports not on the Motherboard but on your case.
Problem solved the Apex background process goes away and Apex is playable again.
