small business venue on rooftop lot

I have been trying to purchase a small business venue placed on a rooftop lot in Ciudad Enamorada but it won't allow me. I noticed it also would not let me purchase community lots on rooftops in San Myshuno.

Is this intentional or a glitch?

I noticed that I can buy the lot as a retail store or resturaunt - just not a small business. I don't want to live on the lot, just run the business there.
