When uploading custom art to the gallery, it tags it as 'mod', and people cannot upload it with their builds if they want to use it. It tags the entire build as mods. This was not the case when I started to make custom art.

I merged your post with the main thread on this.

It does seem it doesn't happen all the time but the design is that custom photos and paintings count as cc.

Correct. Then the custom photos and design should not count as CC. It was not like that before.
