crinrict I was just wondering as I am a xbox player and can not back up saves and such. I do have my old photos saved in a room that is saved in my library, but for the households that are active at the moment if I do not play with the households that I know for sure that have photos will they be safe till the update do you know?

I can't give you any guarantees. A lot of players also say that they don't turn black in the inventory but there's always chances that something else goes wrong.
Are you using up all your slots ? Making a backup with Save as also works. Just something you don't touch until you know that the bug is truely not occuring anymore.

crinrict using up all my slots? sorry I'm unsure what you mean, I only have 1 save maybe I should make more but then it would be pointless playing carrying on a story to only have to go back. altho I guess I could just go back into an old save to get the photos and save them into a room to then upload in to a game I'm playing after its fixed.

I think on console you can have up to 10 different saves but not more. If you have just have one save, you can use the rest rotationally as backups. The game itself also keeps up to 5 backups that you can go to.
As the bug is currently a problem, it's probably not working well if you save under a new name cause that will trigger the error and I don't think there's a way to just make a copy on console without entering the game so for now it's probably best to save them to your gallery/library as well as putting them in the inventory.
Once this is really fixed you can keep backups by just rotationally saving under a new name and use up all those slots. This way you won't loose to much if something goes wrong.
Maybe a console player has other good ideas. I have no idea how they work.
